How to run it

  1. 1Schedule within 10 school days of the decision to change placement, at a time the parents can attend.
  2. 2Pull the whole file beforehand: IEP, evaluations, FBA and behavior plan, teacher observations, discipline and attendance records.
  3. 3Work through the two questions in order and record the evidence behind each answer. Agendiq's summary keeps each decision as it's made.

What is a manifestation determination?
A review required by IDEA before a disciplinary change of placement. The team decides whether the conduct was caused by, or had a direct and substantial relationship to, the disability, or was the direct result of the school's failure to implement the IEP.
When must a manifestation determination meeting be held?
Within 10 school days of any decision to change the placement of a student with a disability because of a violation of the code of student conduct.
What happens if the behavior is a manifestation of the disability?
The team conducts a functional behavioral assessment and puts in place or reviews a behavior plan, and the student returns to their placement unless the parents and district agree otherwise or special circumstances such as weapons or drugs apply.
