How to run it

  1. 1Put the legal factors for each type of variance in the hearing packet so members, applicant and public all work from the same test.
  2. 2Run the hearing in the same order every time: disclosures, staff, applicant, questions, public, rebuttal, deliberation.

Questions people ask

What does a zoning board of appeals do?
It hears requests to vary the zoning code for a specific property and appeals of decisions by the zoning officer. It decides like a court, on the evidence and the legal standard.
What is the difference between a use variance and an area variance?
A use variance allows a use the zoning doesn't permit, such as a shop in a residential zone, and usually needs proof of unnecessary hardship. An area variance relaxes a dimensional rule like a setback or height limit and has a lower bar.
Can you appeal a zoning board of appeals decision?
Usually yes, to a state court within a short deadline set by state law. In New York, for example, it's 30 days after the decision is filed with the town clerk.
